Daniel G. Vincelette

Dan Vincelette has represented over 50 municipalities, school districts and corporations in courts throughout New York State. He is the attorney of record in reported court decisions involving the valuation of commercial, industrial and utility properties including resort hotels, golf courses, condominiums, factories, mines, senior housing facilities, nursing homes, apartment buildings, shopping malls, office buildings and utility properties, as well as exemption issues involving not-for-profit corporations. He also represents municipalities in the tax foreclosure process. He has served as a Deputy Corporation Counsel in the City of Troy since 2005.

 

He is the author of the chapter “Small Claims Assessment Review” in the latest edition of “Review and Reduction of Real Property Assessments in New York” published by the New York State Bar Association. He has presented numerous seminars for the New York State Bar Association, the New York State Assessors Association, the New York State Judicial Training Institute, the New York State Association of Towns and the New York Conference of Mayors.

 

He is the instructor for the annual Board of Assessment Review training sessions held in the Counties of Albany, Schenectady, Rensselaer, Saratoga, Schoharie, Ulster, Otsego, Warren and Washington counties. Dan is also one of the instructors for the training sessions for Small Claims Assessment Review hearing officers sponsored by the New York Judicial Training Institute.

 

Dan is a graduate of Fordham University and Albany Law School, and is the former sports editor of the Greenwich Time newspaper in Connecticut.

Stephen M. Almy

Stephen M. Almy has represented numerous municipalities in courts throughout New York State in assessment trials and appeals.  He is the attorney of record in court decisions involving the valuation of distribution warehouses, senior living facilities, apartment buildings, shopping malls and retail shopping centers.  Stephen coordinates litigation and settlement negotiations with municipal officials, assessors and appraisers and experts at all stages of tax certiorari proceedings.

Stephen received his Juris Doctor from Albany Law School and graduated magna cum laude from the University of Albany where he received his Bachelor’s Degree.

KEY RECENT ACCOMPLISHMENTS

  • Successfully defended the assessment at trial of a tax certiorari proceedings challenging the assessment of a 880,000 sq. ft. distribution warehouse in Fulton County (Wal-Mart #6096 v City of Johnstown, 2019)
  • Successfully argued on behalf of Town in the Appellate Division, Third Department, in appeal of trial decision on valuation of assisted living facility in the Town of Colonie (Brookdale Senior Living Sols. V Town of Colonie Bd. Of Assessment Review, 186 A.D.3d 1801 (3d Dept. 2021)
  • Argued in the Appellate Division, Third Department on the valuation of low-income housing complex in the City of Cohoes (Cohoes Falls Ltd P’ship v Board of Assessment Review, 195 A.D.3d 1126 (3d Dept. 2021)
  • Defended the assessment at trial of an apartment complex in the Town of East Greenbush (Empire Realty Investors I LLC v Town of East Greenbush, 2020)
  • Defended the assessment at trial of a mall anchor retail property in Saratoga County (J.C. Penney v Town of Wilton, 2019)
  • Prepared successful summary judgment and dismissal motions on behalf of municipalities in tax certiorari proceedings based on procedural and substantive issues.
  • Coordinated disclosure and motion practice in tax certiorari proceedings with assessors and appraisers involving valuation of commercial and industrial properties, including senior housing facilities, apartment buildings, condominiums and retail properties.
  • Negotiated settlements on behalf of municipalities related to the valuation of commercial and industrial properties.

Devon J. Casertino

Devon Casertino has represented business owners, developers, municipal entities and individuals in a wide array of matters involving real property and tax law, municipal law, corporate law and real estate transactions throughout New York State. As an attorney, he has assisted in the zoning, tax and municipal compliance aspects of residential and commercial property developments, from inception to completion, in Saratoga Springs and throughout the Capital District. He has represented clients in Supreme, Surrogate and local courts throughout New York State, including experience handling matrimonial, family and criminal law matters.

 

Devon is a graduate of Cortland State University, where he played on the varsity football team, and later received his law degree from Albany Law School after completing a summer in practice for the Saratoga County Public Defender’s office and accelerating his studies to graduate a full semester early.
